Welcome to M2A Aviation Academy LLC. These Terms of Service ("Terms") govern your use of our website, services, and flight training programs. By accessing our website or enrolling in our programs, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not use our services or enroll in our programs.

Acceptance of Terms

By accessing or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are enrolling on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

These Terms constitute a legally binding agreement between you and M2A Aviation Academy LLC. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.

Eligibility Requirements

To enroll in our flight training programs, you must:

  • Be at least 16 years old to solo (17 for Private Pilot)
  • Be able to read, speak, write, and understand the English language
  • Hold a valid FAA medical certificate (or be able to obtain one)
  • Provide all required documentation, including government-issued ID
  • Meet TSA requirements for flight training (for non-U.S. citizens)
  • Comply with all FAA regulations and requirements

Enrollment and Registration

Application Process

Enrollment in our programs requires:

  • Completion of an enrollment application
  • Payment of applicable enrollment fees or deposits
  • Submission of required documentation
  • Acceptance by M2A Aviation Academy LLC

Accurate Information

You agree to provide accurate, current, and complete information during the enrollment process. You are responsible for maintaining and updating your information as needed. Providing false or misleading information may result in termination of services without refund.

Electronic Communications & Signatures

By submitting an enrollment form through our website, you agree to conduct transactions electronically. You acknowledge that your electronic submission constitutes your agreement and intent to be bound by these Terms and any associated fees, and has the same legal force as a physical signature.

Communications & SMS Consent

By providing your phone number and email address, you expressly consent to receive communications from M2A Aviation Academy LLC, including but not limited to: appointment reminders, enrollment updates, and administrative notices.

  • SMS/Texting: You may receive text messages related to your flight training. Message and data rates may apply. Message frequency varies.
  • Opt-Out: You may opt-out of text communications at any time by replying "STOP" to any message received.
  • Privacy: We do not sell or share your mobile consent or phone number with third parties for marketing purposes.

T-Mobile, AT&T, Verizon, and other mobile carriers are not liable for delayed or undelivered messages.

Payment Terms

Tuition and Fees

Students are responsible for payment of all tuition, fees, and associated costs according to the payment schedule agreed upon at enrollment. Payment methods accepted include:

  • Credit/debit cards
  • Bank transfers
  • Financing through approved lenders
  • VA benefits (for eligible veterans)
  • Cash or check (in person)

Late Payments

Accounts with outstanding balances may be subject to late fees and suspension of training privileges. Students with past-due accounts will not be permitted to schedule or continue flight training until the account is brought current.

Price Changes

M2A Aviation Academy LLC reserves the right to adjust pricing for services with reasonable notice. Enrolled students will be notified of any price changes at least 30 days in advance when possible.

Cancellation and Refund Policy

Flight Lesson Cancellations

Students must provide at least 24 hours' notice to cancel or reschedule a flight lesson. Cancellations made with less than 24 hours' notice may be charged the full lesson fee. Weather-related cancellations initiated by the flight school will not incur charges.

Program Withdrawal

Students who withdraw from training programs may be eligible for partial refunds based on the following:

  • Enrollment fees and deposits are non-refundable after 7 days from enrollment
  • Unused prepaid flight hours may be refunded less a 10% administrative fee
  • Ground school materials and supplies are non-refundable once accessed or opened
  • Refund requests must be submitted in writing within 30 days of withdrawal

Program Cancellation by M2A

M2A Aviation Academy LLC reserves the right to cancel programs or discontinue services. In such cases, students will receive a full refund of unused prepaid services or the option to transfer to another program.

Student Responsibilities

As a student, you agree to:

  • Maintain a valid medical certificate throughout your training
  • Arrive prepared and on time for scheduled lessons
  • Complete required ground school and home study assignments
  • Follow all FAA regulations and safety procedures
  • Respect aircraft, facilities, and equipment
  • Conduct yourself professionally and respectfully toward instructors, staff, and other students
  • Report any incidents, safety concerns, or equipment issues immediately
  • Maintain adequate insurance coverage as required
  • Keep your contact information and student records up to date

Code of Conduct

Students must adhere to our code of conduct, which prohibits:

  • Substance abuse or being under the influence of drugs or alcohol during training
  • Harassment, discrimination, or threatening behavior
  • Unsafe operation of aircraft or equipment
  • Violation of FAA regulations or local laws
  • Dishonesty or falsification of records
  • Unauthorized use of aircraft or facilities

Violations of the code of conduct may result in immediate suspension or termination from training programs without refund.

Safety and Risk Acknowledgment

Flight training involves inherent risks. By enrolling in our programs, you acknowledge and accept these risks. You agree to:

  • Follow all safety instructions and procedures provided by instructors
  • Report any physical or medical conditions that may affect your ability to fly safely
  • Participate in required safety briefings and emergency procedure training
  • Maintain situational awareness and exercise sound judgment during all flight operations

Intellectual Property

All content on our website and in our training materials, including text, graphics, logos, images, videos, and software, is the property of M2A Aviation Academy LLC or its licensors and is protected by copyright and other intellectual property laws.

Students may use training materials solely for personal educational purposes. You may not reproduce, distribute, modify, or create derivative works from our materials without express written permission.

Limitation of Liability

To the maximum extent permitted by law, M2A Aviation Academy LLC, its officers, directors, employees, and instructors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services or participation in our programs.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless M2A Aviation Academy, its officers, directors, employees, instructors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of our services, or your violation of any rights of another party.

Insurance Requirements

M2A Aviation Academy LLC maintains appropriate aircraft and liability insurance. Students may be required to obtain renters insurance or additional coverage depending on the training program and aircraft used.

Students are responsible for their own health, disability, and life insurance. We recommend maintaining adequate personal insurance coverage during your training.

Records and Transcripts

M2A Aviation Academy LLC maintains student training records in accordance with FAA regulations. Students may request copies of their records or transcripts with reasonable notice. Records for students with outstanding financial obligations may be withheld until accounts are settled.

Termination

M2A Aviation Academy LLC reserves the right to suspend or terminate your enrollment and access to services at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or our code of conduct
  • Non-payment of fees or charges
  • Unsafe behavior or actions
  • Failure to maintain required certifications
  • Engaging in fraudulent or illegal activities

Upon termination, all rights granted to you under these Terms will immediately cease.

Force Majeure

M2A Aviation Academy LLC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, labor disputes, or equipment failures. In such events, we will make reasonable efforts to resume services as soon as possible.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas.

You agree to submit to the personal jurisdiction of these courts and waive any objection to venue in these courts.

Dispute Resolution

In the event of any dispute, claim, or controversy arising from these Terms, the parties agree to first attempt to resolve the matter through good faith negotiation. If negotiation is unsuccessful, the parties may pursue mediation before resorting to litigation.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any enrollment agreement, constitute the entire agreement between you and M2A Aviation Academy regarding your use of our services and supersede all prior agreements and understandings, whether written or oral.

By using this website and our communication services, you represent that you are at least 18 years of age. If you are under 18, you may only use our services with the express consent and supervision of a parent or legal guardian.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
